MUMBAI: Music label T-Series obtained an interim injunction on 30 May against Yahoo Inc. and Yahoo India from the Delhi High Court. The Court issued a notice, in the interim, restraining Yahoo from streaming T-Series owned content on their portal Yahoo Video. Delhi High Court had issued a notice to Yahoo Inc. and its Indian subsidiary Yahoo Web Services (India) Pvt. Ltd on a suit filed by Super Cassettes Industries Limited (SCIL) owner of the “T-Series” for infringement of their copyright caused by unlicensed streaming of SCIL’s copyright works on Yahoo’s portal www.video.yahoo.com.
On being contacted by Radioandmusic.com, T-Series – marketing media publishing (TV) Vinod Bhanushali says, “We had sent the first notice to Yahoo India on 27 February 2008 stating that they cannot use our IPR without purchasing a license for the same. Following which they replied on 4 March. To further explain them the system, we sent out another letter saying that this is blatant infringement of copyright and action will be taken against them if our content is not removed from their website at the earliest. We had also attached a list of our future movies which they should avoid using.” However, since things didn’t shape up as expected, T-Series went ahead and filed a case in Delhi High Court. The first hearing was on 30 May and the final hearing will be in September. They had filed a lawsuit against Youtube as well and the hearing will be sometime in July. However, they plan to come to certain negotiations before the hearing. Companies like Rediff India, Hungama has the license to run T-Series music and videos.
Bhanushali argues that such websites basically run their content to get advertisers on board. “Ask them to run a blank screen and let’s see who comes to see the advertisements on their website,” he questions.
